I have two of these toploaders and recently the agitator has come loose from the bottom of the tub and the shaft is attached to the agitator. I am thinking that it is the transmission :(

Or could it be a seal?

A very common problem with Maytag transmissions, there is a five year warranty on all parts. The new transmissions have a new design. You should also replace the tub bearing wile you're at it.
