Laundry Owner Must Pay Woman Hurt in Fall

SARASOTA, Fla. (Nov. 15, 2007) —
It took a five-year legal battle, but in the end a jury decided that a laundry owner must pay in the case of a woman who fell in the parking lot as she was carrying her laundry basket back to her van. Ronald Jansen, owner of North Trail Laundryland, will pay Gena Allison $1.35 million. Allison was seeking $4 million.

Jurors, after a seven-day trial, awarded Allison $750,000 for future medical expenses, $240,000 for lost future wages, $200,000 for physical pain and suffering, $100,000 for past medical expenses and $60,000 for lost earnings.

Jurors were convinced that Jansen was negligent because he didn’t deal with a pothole-filled parking lot. In addition to dealing with the negligence issue, Allison’s lawyer also had to prove his client suffered Reflex Sympathetic Dystrophy (RSD) as a direct result of the fall. This disorder is caused by nerve damage and can cause sharp, constant pain.

Jansen’s lawyer tried to convince the jury that Allison was exaggerating the extent of her injury to get a larger settlement.

This guy is the local Dexter distrib. He had plenty of money to fix the parking lot.. maybe not, he has been running 1/2 price washers from 9 to 6am at all his mats. This is a big heads up to spend some money on your property and keep it in reasonably good shape.

My wife worked for attornies for many years. As they got older, and retired, they were replaced by lawyers. What it is the difference. The attornies she started with a admiriable hard working men, who knew the law and tired to help their clients to the best of their ability. They did not take cases that were without merit. They did four times more pro bono work that was required. They were truely gentlemen in the best and old fashioned meaning of the word.

The "Lawyers" were the ambulance chasing scum that we have all come to know and love. Any whacko could get them to file a suit over the most insignificant matter. THey truely were the ones we make jokes about.

Why are they using lawyers instead of lab rats for experiments? For one thing there are so damn many of them! And there isn't anything thing they won't do, whereas and therefore etc the lab rats won't do some things. And the people who run the experments don't get attached to them.

What is the difference between a dead lawyer on the road and a dead snake? There will be skid marks where the cars tried to avoid hitting the snake.

I know some good attornies. But a "Good Lawyer" is an oxymoron.

I will make a prediction that 1.4 MM will get overturned when this case is appealed. $750,000 for future medical expense and $240,000 for lost future wages appears to me to be excessive.

I hope that North Trail Laundryland has liability insurance and he has corporate structure.

why is the laundry owner responsible for the parking lot? Shouldn't it be landlord's responsibility unless he owns the real estate?

I don't want to get into it as it really doesn't pertain to the subject at hand but speaking from current lawyer experience (current RE deal) I can say that they don't care one bit about you or you case or issue, weather it is criminal, civil, RE or whatever, They are lazy, take there sweet ass time and in many cases do not charge an appropriate fee for the type of service or in many cases lack of service they provide. On a RE deal I am working on I have done more than the lawyers have done and that includes my own lawyer. Now I am sure there are lawyers that do not fall into this category but if you find one let me know.

Now In this case I would bet that there is a rightful claim but I can also bet that the lawyers for the plaintiff exagerated the injuries and that is probably at the suggestion of there lawyers.


It saddens me to think that all you laundry owners, most of you who struggle to make money can have it all taken away and in this case a lot more at the blink of an eye by some scum lawyers who makes a BIGGER deal than it actually is.

I hope all you people go out and repave all you parking lots with money you don't have or fix up you store to bring it up to ADA compliance. You never know who will be knocking on your door. Its a sad sad for all small businesses but laundries in particular.

i know this laundry and it's owner, Jansen is a shark in the laundry business in this area, so it's the old story, what you do unto others, comes back to bite you in the as_ in the end. He got what was coming to him.........

To class all lawyers as scum is to say all teachers are suck too. Remember all laundromats are not sleazy untidy little messes with vagrants hanging in them.
Putting classifications on people and things is just bad! Would you like to hear someone say that all laundromats are sleazy scummy holes in the wall?

Now, as far as this lawsuit the case sounds like there is merit. The owner should have fixed the pothole he/she should have cared about his business and his clientelle and their well being to have fixed the parking lot. That is definitely his responsibility.

I think the attorney's job is to get as much awarded to the clients, however the cash settlements and costs of these types of cases have gotten out of control. However, with medical bills sky rocketing how much is too much?
