Hi all,

My store is in shopping center, I paid this month rent just one day late, so the landlord sent me the offcial letter that they will kick me out if one more time not paying before due date!!

Actually, I am worry about my mistake ( I sent(put it in U.S. post office box) the payment three days before due date, but I don't know how it was cashed out one day after due date? maybe U.S. post office delivery was late? or they(the collecting agent for landlord) did not put it in the bank on the same day when they received?....)

My lease is 5 yrs left and then I will need to get new lease...

Does this one time late payment impact in getting new lease after 5 yrs?

I know it's totally up to landlord's decision, but generally speaking, the big landlord like this shopping center ( owner is a big company they own many shopping centers and commercial properties) tends to give new lease for existing tenant favorably as a first choice? or they don't care existing tenant and lease the space to any other person?

Can you let me know about your experince in leasing?
Have you ever done this late payment?
What happened at that time and afterwards?

Reread your lease with a lawyer and see what is written.

Know your rights and the landlord rights it should be cut and dry

There are a couple things you can do to smooth things over. First, unless your rent is substantially below market I doubt they would kick you out over a couple late pays. Normally there us a late charge and that is it. Your payment may have come under the eyes of a pro pencil pusher so you got "the letter". I would send back a letter, noting the date of your check and ask the policy about mailed dates or received dates, then mention you sent it 3 days early and inquire if it should be sent signature required from now on, causing the rental agent to have to go and sign for it. In this way you are throwing yourself to the mercy of the landlord, showing you are really concerned it was not your fault. You could pay the rent with computer banking, my bank guarantee the date of payment, if they do not make it they credit late fee and call the creditor, so blame goes on them.

sounds like your landlord has problems collecting rent. It was just a form letter from the office gal . my set up is I have deposits slips for my landlords account and deposit a check on the first of month works for me. I own rental property and it is a royal pain in arss to collect. just get your check there on time next time. I would not worry about the outrageous threat,

In most big cities up to 20% of retail space is open. A land lord will not I repeat will not let a paying customer go for a couple of late payments over 10-15 years. Property managers are paid based on % full they want 100% it is worth it to them. I have for years always set my rent payments to go 2 business days early so I never have the issue. If he is owner manager he might want the space however know if there is any other space in his strip or close around you are a value to him or her.

Maybe the landlord wants to have a laundromat for himself. Or someone has called wanting to lease a space for a mat and willing to pay more then your paying . We have a Machine dist. contacting landlords and trying to get the buildings away from owners and re opening with new equipment and selling to new people. BE CAREFUL !!

We have the same situation here,But if you have lease he can't kick you out unless he's prepared to offer compensation or fight a court battle with you.
Is the landlord using a management company?.if so,Ring them and ask to speak with the person responsible for your lease.Explain what happened with the rent monies.
Posting rent is a dumb idea.Get your rent deducted automatically from a specific account on a set day.The bank will be responsible for late payment,etc ,your land lord gets paid on time and you sleep easier.
Who is the landlord? is it Westfield Corperation?
