I have a neighborhood feller that drops in and just talks to my employees. Well today he comes by and makes a comment about the red bows attached to some palms we have. Ask when you going to take those bows off, my attendant replies when I can get some big strong man to take the palms down. So he takes them down and in the process after setting one on the floor he rose and caught his head on the bottom of a folding table and cut it, possibly enough to need stiches, I have not seen him. However he has called my attandant twice saying he is sueing for medical attention. Just wondering my legal liability in this case Oh yeah he has been off his medications for multiple personality disorder or(skitsophrenya) pardon the spelling

Do you have a surveillance system in place? (Video is worth a million words sometimes)
Having so could soften the blow.
He was asked to help.
Another good reason to cover yourself.

He probably get free medical care, ie, walk into emergency room, gets treated, they write off the bill. Unless the hospital sues you I would not worry about it, not like you hired him to work for you. You could threaten him with tresspassing if need be..
Just counter sue his ass when you see th papaerwork - for 5 times his amount - and watch him tuck tale and run.

Most insurance policies have medical pay anywhere’s from $1000 to $5000. This medical pay is used so that a small claim does not turn into a big claim.
Most insurance companies will not count it against you if you put in a medical pay claim. In most cases medical pay claims are not considered as a claim.
My policies are:
If an accident occurs the employee on duty fills out an accident report.
The accident victim is asked if they need to go to the emergency room or if they need to have medical attention.
I will report the accident to my insurance agent for informational purposes only. If I have to file a claim latter my agent is aware of the accident.
The day after the accident I will call the victim and ask how they are feeling and tell them how sorry I am that they had an accident.
If the accident victim ever mentions that he is going to talk to an attorney, I will stop all communications with the victim and refer him to my lawyer.
My experience is that small accidents can turn into a big problem if ignored. If a person slips and falls and you encourage them to go to the emergency room they cannot claim you did not offer them medical treatment. If they are a professional “slip and fall” scammer it is best to have them examined as soon as possible to see if there is bruising or redness and to document their injuries if any.
I try to be proactive in dealing with those who are hurt on my property so that a small problem does not turn into a big legal fight.
